| This
discipline deals with the application of psychological/neuropsychologicall
principles and knowledge to the legal arena. In the area of civil
law, a psychological or neuropsychological assessment is used to assess the
nature and extent of the harm suffered by an individual in relation to a specific
event. For example, in the case of a motor vehicle accident, a neuropsychologist
might offer opinions as to whether a plaintiff suffered cognitive and/or emotional
trauma because of that event. They might also assess the emotional injuries suffered
by someone who has been injured in an accident or who witnessed a traumatic event.
Claims of sexual harassment usually need expert psychological input to determine
its impact on the purported victim. In legitimate cases, the assessment will include
determinations of the need for and the cost of treatment. In the arena of
workers' compensation law, a forensic psychologist/
neuropsychologist might be called upon to determine whether the work injury or
stress factors were the predominant and substantial cause, as to all factors combined,
of the alleged psychiatric/neurocognitive injury. Our clinicians are part of most
California Medical Provider Networks (MPNs) and they also function as AME's,
QME's and IME's. In
the criminal arena, issues of competency to stand trial, mental retardation, mitigating
factors and questions of criminal insanity can be answered through a comprehensive
neuropsychological evaluation. These issues are critical when the defendant is
a monolingual Spanish-speaking individual. With
the graying of America, issues of capacity
and undue influence are becoming more frequent. This is an area where neuropsychological
assessment can provide specific answers. Special
